FairMove Direct Terms of Use
FairMove Direct helps Sellers, Landlords, Buyers, Tenants and Property Swap members exchange property information, approved contact details and private messages through one direct property connection platform.
Platform role
FairMove Direct provides an online property connection platform only. Subscription and platform fees purchase access to listing, contact-release and private-messaging facilities. FairMove Direct is not an estate agent, letting agent, property manager, valuer, surveyor, mortgage adviser, lender, insurer, solicitor, conveyancer, escrow service or party to any sale, purchase, tenancy, letting, exchange or Property Swap.
We help Buyers, Sellers, Tenants, Landlords and Property Swap members exchange property information, approved contact details and private messages. FairMove Direct does not buy, sell, rent, let, value, finance, negotiate, guarantee, legally approve or manage any property transaction or Property Swap.
Fees
Registration is free. Seller/Landlord and Property Swap listing packages, together with Buyer/Tenant or eligible contact-access fees, are shown clearly before checkout. These fees pay only for access to the relevant FairMove Direct platform facilities and do not pay for property advice, representation, negotiation, management or completion services. FairMove Direct does not charge estate agent commission, completion commission, viewing fees or negotiation fees.
FairMove Direct responsibility and liability limit
FairMove Direct's service is limited to operating the website, publishing submitted property listings, processing the clearly shown FairMove Direct platform fees and enabling controlled contact release and private messaging. Users are solely responsible for their communications, property information, identity and ownership checks, negotiations, viewings, decisions, agreements, payments to other parties, professional advice, permissions and all legal, financial and safety checks.
FairMove Direct does not accept responsibility for the acts, omissions, statements, conduct, agreements, disputes or losses arising between users, whether these occur through the platform during a paid or free access period or through subsequent telephone, email, messaging-app, social-media, postal, in-person or other off-platform communication. We do not handle deposits, rent, purchase funds, ownership transfers, legal work, conveyancing, negotiations, viewings or any part of the buying, selling, renting, letting or Property Swap process.
To the maximum extent permitted by law, FairMove Direct's liability to a user for a platform service issue is limited to the FairMove Direct fee that user paid for the relevant listing package or contact request. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any other liability that applicable law does not allow us to exclude or limit.
Property Swap and Temporary Home Exchange
Property Swap is a separate connection and messaging service for Permanent Property Swap and Temporary Home Exchange. FairMove Direct is not a party to any proposed exchange and does not value either property, guarantee suitability, verify ownership, approve a transfer, negotiate any value difference, arrange finance, provide legal work, obtain permissions, manage occupancy or supervise an exchange.
For a Permanent Property Swap, each party must use their own solicitors or conveyancers, surveyors, valuers, mortgage advisers or lenders, insurers and other qualified professionals. Any value difference, tax, finance, ownership transfer and legal completion are arranged privately and outside FairMove Direct.
For a Temporary Home Exchange, ownership does not transfer. Each party must obtain every required joint-owner, lender, landlord, council, housing-association, insurer or other permission and independently agree the exchange period, occupancy, bills, repairs, keys, belongings, pets, cancellation, damage, emergencies and safety arrangements.
FairMove Direct's responsibility for Property Swap is limited to its own platform service and the relevant FairMove Direct fee, subject to the liability provisions above and all liability that cannot lawfully be excluded or limited.
User responsibilities
Users are responsible for providing genuine, accurate and legally correct information and for everything they decide, communicate, agree or do with another user. Sellers, Landlords, Buyers, Tenants and Property Swap members must carry out their own identity, ownership, property, affordability, permission, legal, financial and safety checks and use appropriately qualified professionals where required.
Safety
Do not transfer deposits, purchase money, rent deposits or legal funds directly to another user without appropriate professional advice. Property money should be handled through appropriate regulated or professional channels.
Paid services, immediate performance and refunds
Before any listing package, Contact Access package or paid renewal can proceed to checkout, the customer must actively tick the required confirmation. By ticking it, the customer asks FairMove Direct to begin providing the selected service immediately and confirms that they have read and accepted these Terms and the refund rules below.
Contact Access: once Contact Access has been activated or contact information has been released into the registered user’s secure dashboard and/or sent to the registered email address, FairMove Direct has supplied the purchased contact-release service. A refund is not due merely because a request is rejected, unanswered or unsuccessful, because the parties do not continue communicating, because negotiations fail, or because no sale, tenancy or Property Swap is completed.
Listing packages: once a paid listing has been activated and made available through the platform, the service has begun. A refund is not due merely because the listing receives no enquiries, does not lead to a sale, tenancy or exchange, or because the user changes their mind after activation. Any cancellation or refund required by applicable consumer law will still be respected.
FairMove Direct may provide a refund or correction where required by law, including for a duplicate or incorrect charge, or where a genuine FairMove Direct platform fault prevented the purchased service from being supplied. Nothing in this section removes or restricts statutory rights.
For audit and dispute protection, FairMove Direct may record the accepted wording/version, user account and role, Property Ref or request reference, acceptance date and time, Stripe session/payment reference, and the service activation or contact-release time.
Direct contact
Contact details and private messaging are released only after the relevant approval and access or payment-check steps. Once contact is released, both sides are responsible for all conversations, messages, viewings, negotiations, agreements and next steps during the subscription or access period and after they continue communicating outside FairMove Direct.
Listing package fees
Sellers and Landlords choose a public listing duration before checkout. Current Seller/Landlord listing packages are 1 month for £59, 2 months for £110, 3 months for £160, 4 months for £210, 5 months for £270 and 6 months for £330. Buyer/Tenant contact-access package fees are separate and currently start from £30 for 1 month.
